भारत की सबसे बड़ी कार निर्माता, मारुति सुजुकी इंडिया लिमिटेड(MSIL)। प्रतिस्पर्धा नियामक द्वारा एक नीति के लिए 200 करोड़ रुपये का जुर्माना लगाया गया है। जिसके तहत कंपनी ने अपने डीलरशिप और उसके कर्मचारियों को एक्स्ट्रा डिस्काउंट ऑफर करने के लिए दंडित किया है। CCI (competition commission of India) बाजार में कॉम्पिटीशन लेवल पर नज़र रखता है, ऐसे में उसने Maruti Suzuki की एक पॉलिसी को प्रतिस्पर्धा कानून का उल्लंघन करने वाला पाया।

भारतीय प्रतिस्पर्धा आयोग ने Maruti Suzuki की डिस्काउंट कंट्रोल पॉलिसी को एंटी-कॉम्पिटीटिव पाया। साथ ही इस पॉलिसी को लागू करने के लिए कंपनी जो तरीका अपनाती है उस पर भी सवाल खड़ा किया।
MSIL डीलर्स के साथ एक एग्रीमेंट में आया की सभी डीलर्स, मैक्सिमम एक पर्टिक्युलर डिस्कॉउंट दे सकते है कस्टमर्स को उससे हाई नहीं। MSIL ने मिस्ट्री शॉपिंग एजेंसियों (MSA)का इस्तेमाल करके अपने डीलरशिप पर जाकर, यह जांचने के लिए किया कि क्या अतिरिक्त छूट की पेशकश की जा रही है। यदि किसी डीलरशिप को MSIL द्वारा अधिकृत की तुलना में अधिक छूट की पेशकश करते हुए पाया गया, तो कंपनी ने डीलरशिप, मैनेजर, टीम लीडर और ऑफ़र में शामिल प्रत्यक्ष बिक्री कार्यकारी पर जुर्माना लगाया।
लेकिन, इसे Anti- competitive क्यों माना गया?
Discount control mechanisms को anti-competitive माना जा सकता है यदि वे इंटर-ब्रांड या इंट्रा-ब्रांड प्रतिस्पर्धा को प्रतिबंधित करते हैं, और उपभोक्ताओं को उत्पादों के लिए सर्वोत्तम मूल्य नहीं मिल रहा होता। CCI ने पाया कि पैसेंजर वेहिकल सेग्मेंट में, MSIL की सबसे बड़ी बाजार हिस्सेदारी थी और (MSIL) द्वारा Resale price management (RPM) ने न केवल इसके डीलरों के बीच प्रतिस्पर्धा को बल्कि अन्य ब्रांडों के साथ प्रतिस्पर्धा (Competition) को भी नकारात्मक रूप से प्रभावित किया।
